Spór o wygaśnięcie konkordatu polskiego z 1925 roku
Abstrakt
In 1945 the Warsaw government is sued a re solution in which it stated that the Holy See broke off the concordat with Poland which had been established on 10 February 1925. This was clue 10 the legal acts issued during the occupation, all of them being contrary to the concordat. The author seeks to give an answer to the following questions: how and when the Polish concordat ceased to be binding, both in the international and Polish law; to what extent the objections put forward against the Holy Sec by the Polish government in the post-war period were justified. The inference was based on the rules and customs of the international law, taking into account the specific character of the concordat law, as well as the Canonical and Polish law then binding. Apart from a legal analysis of the controversial acts issued by the Holy See, the author has attempted to explain the motives behind those actions under particular political circumstances.
