Age of Discretion in the Code of Canon Law (Can. 891, Can. 989) in the Light of Canonical Tradition

Abstract

The study refers to the notion of age of discretion, that is mentioned in two norms of the present Code of Canon Law (can. 891, can 989 CIC). This phrase appears nowadays in two latin versions aetas discretionis and ad annos discretionis. Since it is rooted in medieval Canon Law, according to the rule of interpretation stipulated by can. 6 § 2, in order to explain the meaning of the current legislation it is advisable to reach for canonical tradition.

In the first part of the article there is touched upon the sense of expression aetas discretionis in the context of the Constition 21 of the Lateran IV and medieval glossators. The second part discusses the issue as presented in the decree Quam singulari and the Pio Benedictine Code. In the third part the author reviews the problem of confirmation age, from can. 788 of the 1917 Code of Canon Law to can. 788 of the 1983 Code. Also in the current legislation there is valid the notion of age of discretion for the confirmation, unless the episcopal conference decides otherwise. The forth part focuses on age of discretion needed for confession according to can. 989, with reference to the age of the First Holy Communion.

This study allows to better understand the notion of age of discretion, present both in the current legislation regarding Confirmation as welrecs First Confession and Communion. Consequently we should reflect on the pastoral programs regarding the sacraments of initiation. It’s highly recommended not to overlook the minimarecge of discretion provided by the canons of the current Code.
