Modern Trends in Testament Succession. Inclusion of Video-Testaments in the New Civil Code and Other Issues

Abstract

Civil Code requires changes, especially in the area of testament succession. The existing forms of testaments do not fully satisfy the principle of free testation and do not necessarily permit to substantiate the last will of a testator. Due to ongoing legislation work it seems sensible to give some thought to this area and consider which forms of the existing testament disposals ought to remain in our legislation and which new forms should be added. The Author undertakes this task, proposing that video-testament be included in Polish legal system and the forms of existing testament disposal altered so that they fit the present situation.
