The Duties of a Suspect During Petty Offence Proceedings
Abstract
While evidence is being heard, the suspect is the main source of information about the committed offence. As a person to give testimony, he or she may provide explanation or information concerning the state of his or her organism. In order to gain essential knowledge, law enforcement agencies seek, secure and preserve evidence. They can oblige the suspect to participate in the proceedings even if the suspect is not willing to do so. The presented article analyses a suspect’s duties and his/her legal situation which is due to the operations performed by law enforcement agencies. The legal regulations presented here, forming the basis of procedural duties of a suspect, pertain to petty offence proceedings and penal proceedings in general, the latter being employed only in selected cases determined by the Petty Offences Code.
