Renunciation of a Privilege (Can. 80, §§ 1-3)
Abstract
In this study the Author elaborates on Canon 80, §§ 1-3 of the Code of Canon Law, with regard to renunciation of a privilege. The analysis demonstrates that renunciation of a privilege should be treated as an exceptional case. As a rule, the person who was granted grace by a competent authority should use it as it was granted for his or her good.
The Author demonstrates that in order for this kind of act to be valid the decision of the person should be received by a competent authority. What is more, this intent may not contradict the principle of ecclesiastical common good and the good of others. In the Author’s opinion, the adoption of this principle guarantees harmonization of Church’s common good with the need for adjustments of particular cases so that individuals can be redeemed.
