Incardination and Excardination of Clerics in the Codes of Canon Law of 1917 and 1983
Abstract
The aim of the article is to present the evolution of the legal institution of incardination and excardination over the last sixty-six years, from the promulgation of Code of Canon Law by Benedict XV to the new version of the Code by John Paul II. The Author discusses the meaning of incardination and excardination in the hierarchical structure of the Church and the question of diocesan and monastic affiliation in the Code of 1917. Emphasis is placed on the modification of this legal institution in connection with the changing circumstances of pastoral care, especially the resolutions of the Second Vatican Council. Also, the provisions of the Code of 1983 are analysed with regard to clerical affiliation with Church administrative structures.
