General Prerequisites for Legal Significance of Erros
Abstract
This article lists and characterises all general prerequisites that must exist for a person to effectively adduce a defect (error) of a declaration of will. The article is divided into five parts. The first part discusses the definition of error and its qualification in various legal systems. The second part explains the relation between error and the substance of an act in law. The third and fourth parts discuss the prerequisite for significance of error and such prerequisites in the case of declarations of will directed at a particular person. The final, fifth part deals with a draft amendment to the Civil Code in the section related to error.
