Application of EU Norms in Polish Law on Religious Denominations. Selected Issues

Abstract

The treaty law of the European Union guarantees religious freedom at personal and community levels. It also envisages the possibility to lay down norms which determine the legal status of churches and non-denominational organizations. The Author discusses the rules regarding the relationship between EU law and domestic legal order laying particular stress upon the regulations concerning the approach of the EU towards domestic regulations incorporated in the Lisbon Treaty which amended the Treaty on European Union and the Treaty establishing the European Economic Community as well as the decision of the European Court of Human Rights in Strasbourg.
