The Notion of Foundation in German Law

Abstract

The article presents the notion of foundation in the German law, arrived at through judicature and the doctrine. The Author characterises its elements that are objectively relevant, that is the mission, assets and structure of a foundation. For a more comprehensive view of the subject matter, the reader is presented with issues relating to legal personality and typology of a foundation in the German legal system.
