European Order for Payment Procedure in Cases of Individual Labour Law
Abstract
European order for payment procedure has been part of the Polish civil procedure since 1 July, 2009, and it is a result of intensive Europeanization of the Polish adjective law. Newly created, the separate procedure provides and alternative to domestic procedures. If the new rules of proceedings are to be benefited from, one has to determine whether a given case belongs to the transborder body of cases and the subject of procedure meets the criteria spelled out in Article 4 of regulation no. 1896/2006 by the European Parliament and Council. The fulfilment of the above conditions permits a full utilization of the new „kind” of procedure in cases pertaining to labour law.
