The Awarding of Public Supply Contracts by Energy Sector Entities in the Relation: The Awarding Entity Versus Dependent Subject
Abstract
The focus of the study is the obligation to use the provisions of Act on Public Procurement in terms of the relation between the awarding entity and dependent subject (this term was used by the legislator in the context of the formerly effective act on public procurement) when contracting supplies. The broad scope of the issue required that features of the entity which places an order be determined, as well as the features of the subject accepting the order, and the object of the contract. This allowed the author to demonstrate the complexity of the problem in its practical aspect, which is here done by demonstrating doubts that arise when hypothetical cases are considered.
