The Possibilities and Effects of Establishing Marriage despite Obstacles in the Canonical and Polish Law

Abstract

Responding to the social need to know the system of the canonical and Polish lay law in view of the concordat of July 28, 1993, the author show' one of the essential issues implied by art. 10 of the at document, i.e. the influence of marital obstacles on the validity of sacramental marriage and the validity of marital contract in the Polish law. He discusses the system of dispensations in the Canonical law and legal permits in the Polish law, the permits which repeal the obstacles making it (the Canonical law) valid or non-actionable (the Polish law). Moreover, the list of obstacles in the two legal systems is of value, especially it is of great cognitive importance that the author has compared the effects of establishing marriage despite the breaking off obstacles or negative premisses of marriage establishment.
